What Does a DOT SAP Report Include for Georgia CDL Drivers?
A DOT SAP report documents the Substance Abuse Professional's evaluation and recommendations, or the SAP's later determination about compliance. It is not a return-to-duty drug test result. For Georgia CDL drivers, understanding these separate records helps clarify what the SAP handles and what remains before a return to safety-sensitive work.
This guide covers drivers subject to FMCSA drug and alcohol requirements. It summarizes federal rules, not a separate Georgia SAP reporting system.
Who determines the education or treatment recommendation?
The SAP does. Under 49 CFR 40.293, the SAP conducts an individualized evaluation and determines the required education and/or treatment. The driver does not determine or prescribe that recommendation. The SAP also serves as the referral source under 49 CFR 40.299.
The recommendation is based on the individual evaluation. DOT specifically directs SAPs not to use the same or substantially similar plans for most people they evaluate. Another driver's requirements do not establish yours.
What information is in the written SAP reports?
The initial report identifies the employee and employer, violation and date, evaluation date and format, SAP recommendations, and SAP telephone number. It must be signed, dated, and on the SAP's letterhead.
A successful-compliance follow-up report also addresses the program provider, participation dates, clinical assessment of participation, compliance determination, follow-up testing plan, and continuing-care needs. Section 40.311 specifies the complete required contents for each report type.
Who receives the SAP report?
The SAP sends the required written reports directly to the designated employer representative (DER), subject to the regulatory exception identified in Section 40.311(a). A consortium/third-party administrator (C/TPA) may receive a simultaneous copy. The employer must receive an unchanged report from the SAP.
If you have no current employer, the SAP must provide the reports directly to you, and to a gaining DOT-regulated employer if you later obtain a safety-sensitive position. You can start the SAP process without a current employer.
Is the written SAP report uploaded to the Clearinghouse?
No. FMCSA distinguishes the written reports from the information the SAP records in the Drug and Alcohol Clearinghouse.
The SAP reports two dates: the initial SAP assessment date and the date the SAP determines the driver is eligible for return-to-duty testing. The education/treatment plan and written SAP reports are not uploaded to the Clearinghouse; those documents are handled outside it.
A Clearinghouse status update and a written SAP report therefore serve different purposes. Seeing an update in your account does not mean that the report itself is stored there.
How does the SAP determine successful compliance?
The SAP conducts a follow-up evaluation. Under Section 40.301, this includes obtaining appropriate documentation from, or conferring with, the education or treatment professionals and conducting a clinical interview with the driver.
The SAP determines whether the driver has successfully complied with the recommendations. If the SAP determines that the driver has not demonstrated successful compliance, the SAP gives written notice to the DER, and the employer must not return the driver to safety-sensitive duties.
Does a successful SAP report mean you can drive immediately?
No. Under Section 40.305, return-to-duty testing comes after the SAP determines successful compliance. Before safety-sensitive work resumes, the required drug test must be negative and/or the required alcohol test must show a concentration below 0.02.
The employer decides whether to return the driver to safety-sensitive work. A successful SAP determination does not guarantee reinstatement or employment, and the SAP does not make the employer's hiring decision.
Where can Georgia drivers begin a DOT SAP evaluation?
