Can CBD Cause a Positive DOT Drug Test for Virginia CDL Drivers?
Yes. Using a CBD product can lead to a positive DOT drug test if it exposes you to THC. DOT tests for marijuana, not CBD itself. DOT also states that claiming CBD use is not a legitimate medical explanation for a laboratory-confirmed marijuana-positive result.
For Virginia CDL drivers, the key distinction is between a product's retail label and the federal rules governing a DOT test. This article explains that distinction, the Medical Review Officer's role, and what a Substance Abuse Professional does after a verified violation.

Does a CBD label guarantee a negative DOT test?
No. DOT warns that some CBD products can contain more THC than their labels indicate. A claim on a package is not a DOT test result and should not be treated as a guarantee that a driver will test negative.
The practical point is narrow: this article cannot certify a CBD brand or product as safe for DOT testing. It also cannot predict a test result from a label, dose, or time since use.
Who decides how a positive laboratory result is verified?
The Medical Review Officer, or MRO, reviews laboratory results and evaluates medical explanations. The MRO is a licensed physician; this role is separate from the SAP evaluation.
Under 49 CFR 40.137, the MRO must give the employee an opportunity to present a legitimate medical explanation. The rule sets the standards for verifying the result. A driver's explanation should be addressed through that review, not treated as something a SAP can later use to rewrite the result.

Does a Virginia medical marijuana authorization change the DOT standard?
No. A Virginia driver should not confuse state medical marijuana documentation with a federally valid explanation for a positive DOT test. DOT's May 2026 guidance says state-issued cards, physician recommendations or certifications, and dispensary records do not satisfy Part 40's requirements for a legitimate medical explanation.
That guidance specifically addresses state-licensed marijuana products. It is not a statement that every prescription medication is disallowed. Medication questions and relevant prescription information belong with the MRO under the applicable verification rules.
What happens after an MRO-verified positive DOT drug test?
Under 49 CFR 40.23, an employer receiving a verified positive must immediately remove the employee from safety-sensitive duties. The employer must not wait for the written report or a split-specimen result before taking that action.
Returning to safety-sensitive work requires the applicable return-to-duty process. Removal from those duties and an employer's decision about continued employment are different matters; a SAP appointment does not guarantee a job or an immediate return to driving.
Can the SAP waive requirements because the driver reports CBD use?
The SAP conducts an individualized assessment and determines the required education and/or treatment. The SAP also makes the referral. These are professional decisions, not client-selected courses or client-recommended programs.
Under 49 CFR 40.293, the SAP must treat a verified positive as establishing a DOT violation for the evaluation. Claims intended to minimize the violation, including assertions about hemp oil or medical marijuana, cannot be used as a factor in determining the recommendation. The SAP must still evaluate the individual rather than apply the same plan to everyone.

Does completing the SAP recommendations mean you can drive immediately?
No. Under 49 CFR 40.305, return-to-duty testing cannot occur until the SAP determines that the employee has successfully complied with the prescribed education and/or treatment. For a drug violation, a negative return-to-duty drug test is required before safety-sensitive duties resume.
The employer is responsible for ensuring the required return-to-duty test occurs and deciding whether to return the employee to safety-sensitive work. Successful compliance does not require an employer to rehire or reinstate a driver.
