Who Orders the Return-to-Duty Test After the DOT SAP Process?

After a DOT drug or alcohol violation, many drivers focus on one question: when can I take the return-to-duty test? The answer depends on where you are in the DOT SAP process and who is legally allowed to order the test.

For FMCSA-regulated drivers in North Carolina and South Carolina, the return-to-duty test is not something the driver schedules on their own. It is also not ordered by the Substance Abuse Professional. The SAP has a specific role, but the employer or an authorized consortium/third-party administrator handles the return-to-duty test.

The SAP Determines When You Are Eligible

The SAP completes the initial evaluation, makes the required education or treatment recommendation, reviews completion documentation, and conducts the follow-up SAP evaluation. If the driver successfully complies with the recommendation, the SAP reports the required completion information in the FMCSA Clearinghouse.

That Clearinghouse update means the driver is eligible for return-to-duty testing. It does not mean the SAP orders the test, schedules the collection, chooses the testing site, or returns the driver to safety-sensitive work. The SAP’s role is to determine compliance and report eligibility according to DOT requirements.

The Employer or C/TPA Orders the RTD Test

Once the SAP marks the driver eligible, the return-to-duty test must be ordered by a DOT-regulated employer or an authorized consortium/third-party administrator, often called a C/TPA. This is a key point for drivers who are not currently employed or are applying for a new driving position.

If you already have an employer, the employer’s designated employer representative or testing program contact usually coordinates the next step. If you do not have an employer, you may need to work with a qualified C/TPA or wait until a prospective employer is ready to move forward with the return-to-duty process.

Why Drivers Cannot Order Their Own Test

A return-to-duty test is not the same as a personal drug test or a test arranged outside the DOT testing program. It must be ordered and handled under DOT procedures so it can be reported correctly and connected to the driver’s return-to-duty status. A self-ordered test will not replace the required DOT return-to-duty test.

This is one reason communication matters. Before the follow-up SAP evaluation, drivers should make sure they know who their employer or C/TPA contact will be after eligibility is entered. That can prevent confusion when the SAP portion is complete but the RTD test still needs to be arranged.

What You Can Do to Keep the Process Moving

Drivers can help prevent delays by completing intake paperwork, designating the SAP in the FMCSA Clearinghouse, attending the initial evaluation, completing the SAP recommendation, and submitting proof of completion promptly. After the follow-up evaluation, ask your employer or C/TPA what they need to arrange the return-to-duty test.
