What Happens at a DOT SAP Follow-Up Evaluation in Tennessee?
A DOT SAP follow-up evaluation is a clinical appointment in which the Substance Abuse Professional determines whether you have successfully complied with the education and/or treatment recommended after your initial evaluation. For Tennessee CDL drivers, the SAP reviews information from the recommended program and interviews you before making that determination. A course certificate alone does not replace this appointment, and a successful follow-up does not, by itself, authorize a return to commercial driving.
What does the SAP review at the follow-up evaluation?
Under 49 CFR 40.301, the SAP must confer with the education or treatment professionals or obtain appropriate documentation from them. The SAP must also conduct a clinical interview to determine whether you demonstrated successful compliance with the initial recommendations. DOT’s follow-up evaluation rule
That review involves more than checking whether a certificate exists. The SAP evaluates your participation and compliance with the individualized recommendation. Be prepared to discuss your experience honestly and to clarify information the SAP needs. There is no set of answers that guarantees a favorable determination.
The SAP’s responsibility is transportation safety. The SAP makes the clinical decision, rather than the driver, course provider, or employer deciding that the process is finished. DOT’s description of the SAP role
How can you prepare for the appointment?
Check the documentation instructions. Ask your SAP which records are needed from the education or treatment program and how those records should be provided. Use the secure delivery method the SAP specifies.
Follow the recommendation you were given. Keep track of your attendance and the documents requested, but do not assume that finishing a class automatically establishes successful compliance.
Communicate practical problems. Tell your SAP about missing records, scheduling difficulties, or barriers to the recommended services. Ask for clarification rather than substituting a course or provider yourself.
Prepare for an uninterrupted conversation. For a virtual appointment, use a private setting and a device with reliable audio and video. Confirm the appointment time and that you will be physically located in Tennessee.
Only the SAP who made the initial evaluation may modify the initial evaluation and recommendations based on new or additional information. An employer’s deadline or a driver’s preference does not transfer that authority. 49 CFR 40.297
Can a Tennessee SAP follow-up evaluation be virtual?
Yes, when the SAP determines that a remote evaluation is appropriate and the applicable credential and technology requirements are met. DOT requires real-time audio and visual interaction, sufficient quality to gather the information available in person, and protection of confidential communications. An email exchange or a telephone-only call does not meet those remote-evaluation requirements. DOT’s remote evaluation requirements
Three Corners Counseling offers secure video SAP evaluations for eligible individuals physically located in Tennessee. Availability and suitability are confirmed when scheduling. Education or treatment may have its own attendance requirements, and return-to-duty testing is arranged separately.
What if the SAP does not find successful compliance?
The SAP must document the determination. The employer cannot return you to safety-sensitive duties after a determination that you have not successfully complied. Ask your SAP to explain your current status and the next steps that apply to your circumstances.
The rule also allows the SAP, in some circumstances, to find successful compliance while recommending continuing treatment or aftercare. This is an individualized clinical determination, not permission to stop services on your own. Neither a fixed number of days nor a completion document guarantees the outcome. How DOT defines the follow-up determination
How is this different from return-to-duty and follow-up testing?
The follow-up SAP evaluation is the clinical review of your compliance with the SAP’s recommendations.
The return-to-duty test is a separate DOT drug and/or alcohol test that occurs only after the SAP determines successful compliance. The employer ordinarily arranges it, with the applicable C/TPA pathway available in specified circumstances.
Follow-up testing is the continuing testing program after you resume safety-sensitive work. The SAP establishes the plan, and the employer implements it. It is not another name for the follow-up evaluation.
A successful SAP determination does not require an employer to hire or reinstate you. Required testing and the employer’s return-to-work decision remain separate. DOT’s return-to-duty requirements
DOT also distinguishes the SAP’s written testing plan from the clinical appointment. 49 CFR 40.307
What should Tennessee CDL holders check before driving again?
Tennessee’s Department of Safety and Homeland Security explains that a prohibited Clearinghouse status affects commercial driving privileges. Completing the SAP follow-up evaluation alone does not change that status to not prohibited or reinstate a downgraded CDL. Tennessee’s Clearinghouse and CDL guidance
After the required return-to-duty steps and reporting are completed, check your Clearinghouse record and resolve any Tennessee Driver Services reinstatement requirements before resuming commercial driving. A SAP appointment, a test result, and the status of your Tennessee commercial driving privileges are separate things to verify. Do not assume that an appointment confirmation or certificate is authorization to drive.
Do you need an employer before completing the SAP evaluations?
No. FMCSA guidance allows the SAP evaluation, referral, and follow-up evaluation to take place before you receive an employment offer. You can start the process and begin the SAP’s recommendations without an employer. Employer or authorized C/TPA involvement belongs to the separate return-to-duty testing and reporting steps. Does Three Corners Counseling’s fee include the follow-up?
Yes. The $400 Tennessee SAP fee includes the initial evaluation, review of completion documentation, follow-up evaluation, and required SAP updates in the FMCSA Clearinghouse. Recommended education or treatment and return-to-duty testing costs are separate. The fee does not guarantee a particular recommendation, completion date, employment outcome, or license reinstatement.
