Can I Switch DOT SAP Providers in Tennessee?

If you are a Tennessee CDL driver and want to change DOT Substance Abuse Professionals, the answer depends on where you are in the FMCSA Clearinghouse process. Before a SAP accepts your designation, you may be able to correct the selection. After the SAP accepts, however, federal rules do not allow you to shop for a different evaluation because you disagree with the recommendation. Can Tennessee Drivers Switch DOT SAP Providers?
A driver should contact a DOT-qualified SAP before sending a Clearinghouse designation. If the request is still pending and you selected the wrong SAP, address the mistake promptly in the Clearinghouse and contact the intended provider before an evaluation begins.
Once the designated SAP accepts the request, FMCSA’s driver instructions state that you cannot simply designate a different SAP. If unforeseen circumstances prevent the designated SAP from fulfilling the required role, FMCSA directs the driver to contact the Clearinghouse for assistance. That is different from changing providers because the recommendation is inconvenient, costs more than expected, or takes longer than hoped.
Why a Second SAP Evaluation Cannot Replace the First
Under 49 CFR § 40.295, an employee or employer may not seek a second SAP evaluation to obtain a different recommendation. Section 40.297 also prohibits changing the initial SAP’s evaluation or recommendations, except that the original SAP may modify them based on new or additional information.
The original SAP is responsible for the individualized initial evaluation, education and/or treatment recommendation, review of completion information, follow-up evaluation, and required return-to-duty eligibility reporting. These connected responsibilities are why the process is not designed for routine transfers between SAP providers after the initial evaluation.
What to Do Before You Designate a Tennessee SAP
Confirm the SAP’s name and practice information, ask whether the SAP can evaluate you while you are physically located in Tennessee, review the fee and scheduling process, and make direct contact before submitting the Clearinghouse request. A SAP should not accept a designation from a driver with whom the SAP has not established a working relationship.
You can start the DOT SAP process without a current employer. You do not need an employer to designate a SAP, schedule or complete the initial evaluation, or begin the SAP’s required education and/or treatment recommendation. Employer or C/TPA involvement becomes important later, when the return-to-duty test and required Clearinghouse reporting must be handled through the proper FMCSA process.
If Your Current SAP Cannot Complete the Process
Document the problem and contact the FMCSA Clearinghouse for case-specific assistance. Do not assume that a new provider can simply overwrite the accepted designation, repeat the evaluation, or replace the first SAP’s recommendation. The correct next step depends on the Clearinghouse record and the circumstances that prevent the original SAP from continuing.
If you have not yet designated a SAP, contact the prospective provider first. If you already have an accepted designation, start with the designated SAP unless FMCSA gives you different instructions.
